한국인 전용 전문직 미국 취업 비자 (E-4 Visa) 미 의회 통과를 위한 지지 서명 운동

2012년 한미 FTA(자유무역협정) 발효 이후 한미 간 경제 교류는 더욱 확대되어 현재 한국은 미국의 세계 제 6위 교역 대상국이 되었습니다.

대미 투자의 확대로 2021년 1월 이후 총 투자액은 550억 달러에 이르고 있습니다. 이는 아태 지역 기업들의 민간 투자 총액의 4분의 1을 차지하는 규모입니다.

이러한 양질의 대미 투자는 미국의 고용 창출로 이어져, 2023년 3월 기준 미국 내 한국 기업의 고용 인원은 177,000명에 이릅니다.

이러한 한국 기업의 미국 진출 확대에 발맞추어 업무의 능률 향상과 경쟁력 제고를 위해 미국 내에서 보충하기 어려운 전문직 한국인의 고용 또한 필수적입니다. 현재의 H-1B 전문 비자는 전 세계적으로 1년에 65,000 비자로 제한되어 있어 매년 중국과 인도계 신청자가 약 65%를 차지하여 쿼터가 곧 고갈되어 한국인이 혜택을 받기가 극히 어렵습니다.

따라서 한국인 전용 E-4 전문직 취업 비자 법안(Partner with Korea Act - 한국과 파트너하기 법안)의 미국 의회 통과가 더욱 절실해졌습니다.

이러한 한국인 전용 E-4 전문직 취업 비자 법안은 미국 내 자국민 인력 시장을 침해하지 않으며, 미국 내 투자 기업들에게 한국의 우수한 인적 자원, 기술력, 그리고 첨단 산업에 필요한 인프라 구축을 보다 수월하게 할 수 있도록 합니다.

이는 미국 내 자국민뿐만 아니라 미국 내 투자 기업들에게도 모두 윈-윈할 수 있는 새로운 기회를 제공할 것입니다.

또한 E-4 Visa를 통해 미국에서 취업할 경우 본인 가족(배우자 및 만 21세 이하 자녀)도 동반할 수 있는 좋은 기회가 될 것입니다.

E-4 비자 법안 제정은 한국인 전문직의 미국 진출과 함께 미국 진출 한국계 기업 및 미주 한인 사업체의 부족한 인력을 보충하는 데 필수적입니다. 이는 미국의 생산성 증대와 사업 확장에 도움이 되는 현지 충원이 어려운 인력으로서 고용 창출에 기여할 수 있기 때문입니다. 현재 많은 미국 기업들이 전문직 인력 부족으로 인해 업무 효율성과 사업 확장에서 어려움을 겪고 있어, 미 경제계에서도 외국 전문 인력 취업 비자의 확대를 요구하고 있습니다.

이러한 E-4 취업 비자는 미국과 FTA를 체결한 다른 국가들에게는 허가되었으나, 2012년 한미 FTA 체결 시 한국인의 E-4 취업 비자는 포함되지 않았습니다. 이는 한국의 몫을 얻기 위해 2014년부터 6차례에 걸쳐 Partner with Korea Act가 미국 의회에 제출되었으나 아직까지 통과되지 않았습니다.

최초로 제출된 114차 의회에서는 총 111명의 미 연방 하원 의원이 법안에 서명했지만, 가장 최근인 제 118차 의회에서는 지지 의원이 42명 서명했습니다. 이는 우리 미주 한인 사회의 정치적 무관심을 반영한 결과입니다.

그러나 우리 미주 한인 사회는 4명의 연방 하원 의원과 수십 명의 선출직 공무원을 배출한 저력을 가지고 있으며, 이를 통해 이 법안을 통과시킬 수 있을 것이라 믿습니다. 이에 각 지역 한인 단체들이 해당 지역의 연방 상하원 의원들과 접촉하여 Partner with Korea Act를 지지하고, 동 법안이 빠르게 미국 의회에서 통과될 수 있도록 노력해 주시기를 요청드립니다.

Support Signature Campaign for Korean-Specific Professional Employment Visa (E-4 Visa) in the U.S. Congress

Since the enactment of the 2012 Korea-U.S. Free Trade Agreement (FTA), economic exchange between South Korea and the United States has significantly expanded. Currently, South Korea ranks as the 6th largest trading partner of the U.S., with total investments reaching $55 billion since January 2021. This constitutes a quarter of the total private investments from Asia-Pacific region companies.

These high-quality investments from South Korea have translated into job creation in the U.S., with South Korean companies employing approximately 177,000 people as of March 2023. To further align with the expansion of South Korean businesses in the U.S., it is essential to supplement the workforce with specialized Korean professionals for enhanced efficiency and competitiveness.

Currently, the H-1B visa, which is intended for skilled professionals globally, is capped at 65,000 visas annually, and with about 65% of these visas typically going to applicants from China and India, Korean applicants face extreme difficulty in securing these benefits. Therefore, the urgency for the U.S. Congress to pass the Korean-specific E-4 Professional Employment Visa Act (Partner with Korea Act) has become more critical.

The Korean-specific E-4 Professional Employment Visa Act aims to facilitate the establishment of South Korea's excellent human resources, technological expertise, and necessary infrastructure for advanced industries in U.S. investment companies, without infringing upon the U.S. domestic labor market. This initiative will present a win-win opportunity not only for U.S. citizens but also for U.S. investment companies. Furthermore, obtaining an E-4 Visa for employment in the U.S. will also provide a favorable opportunity for family members (spouses and children under 21) to accompany the applicant.

The enactment of the E-4 Visa Act is crucial not only for the expansion of South Korean professionals in the U.S. but also for addressing the workforce shortages in U.S.-based South Korean businesses and Korean-American enterprises. This will contribute to enhancing productivity and business expansion in the U.S. by filling the gaps with skilled foreign workers who contribute to job creation. Many U.S. companies currently face challenges in operational efficiency and business expansion due to shortages in specialized professional labor, prompting demands within the U.S. economy to expand visas for foreign professional workers.

While other countries with FTAs with the U.S., such as Australia (10,500 annually), Singapore (5,400 annually), Chile (1,400 annually), Mexico (unlimited), and Canada (unlimited), have been granted specific visa allowances, Korean nationals were excluded from the E-4 Visa category when the Korea-U.S. FTA was signed in 2012. Since then, the Partner with Korea Act has been introduced to the U.S. Congress six times from 2014 onward, yet it has not been passed.

In the initial submission to the 114th Congress, 111 members of the U.S. House of Representatives signed the bill; however, support decreased to 42 signatures in the most recent 118th Congress. This decline reflects political indifference within our Korean-American community. Nonetheless, with the strength of four members of the U.S. House of Representatives and numerous elected officials from our Korean-American community, we believe we can pass this legislation.

Therefore, we urge Korean-American organizations in each region to contact their respective federal legislators and advocate for the Partner with Korea Act, ensuring its swift passage through the U.S. Congress.
